Ryan International Airlines requests Exemption from SFAR 112 to be able to fly across Tripoli FIR above 20,000 feet in support of a Wet Lease agreement with AtlasJet, a Turkish carrier, on a regular route between Turkey and Nigeria.
The following information is provided: • The rule requirement from which exemption is sought; SFAR112 “Prohibition Against Certain Flights Within the Tripoli (Hill) Flight Information Region” • The nature and extent of the requested regulatory relief; Allowance for a US registered aircraft flown by Ryan International Airlines, a US FAR121 air carrier to transit the Tripoli FIR above 20,000 feet on routes between Turkey and Nigeria. • A description of each person or aircraft to be covered by the exemption; AIRBUS A330-223, MSN number 343, registration number N772RD. • Any information, views, or arguments to support the action sought; The threat from Libya since the downfall of the Gaddafi regime has subsided. European and other carriers have resumed overflight of Libya. The requirement to go around the Tripoli FIR adds an additional one hour of flying time for each round trip. • The reasons why a grant of exemption would be in the public interest; and The underlying rationale for the restriction has lapsed. To restrict just the US carriers from the overflight of Libya puts the US carriers at a competitive disadvantage with other world carriers and European carriers specifically. • The action to be taken by the petitioner to provide a level of safety equivalent to that provided by the rule from which exemption is sought or the reason why a grant of exemption would not adversely affect public safety. Asking for approval to fly above 20,000 feet is similar to the restriction that is placed on US carriers in other countries such as Iran, Iraq, Somalia and Ethiopia.
