The Student Press Law Center,, urges the Department to incorporate into its assessment of postsecondary institutions a component reflecting those institutions' level of public transparency, including compliance with existing state and federal disclosure laws. Because disclosure laws are systematically under-enforced (often requiring resort to cost-prohibitive and time-prohibitive civil litigation), recognizing transparency as a matter of educational quality will create a meaningful incentive for institutions to be responsive to public inquiries. Specific recommendations for incorporating a "transparency index" into the Department's institutional ratings are spelled out in the attached comment filing.
